就讀東華大學的學生陳旻傑先前因不滿就讀花蓮高中時，拒絕參加朝會升旗被學校記3次警告，提起行政訴訟抗罰，結果敗訴確定。之後他向東華大學提告要求返還800元，因為不滿被學校收取1年400元停車費用，認為校方不當得利。台北高等行政法院審理後，認為該些費用為利用校園設施的使用規費，與一般業者營利不同，判決陳男敗訴確定。

根據判決，陳男於2020年、2021年都有向校方申請停車識別證，依規定繳交共800元清潔管理費。

之後陳男主張，校方未經主管機關核備就違法設立停車場且收費，為不當得利，校方自訂的管理辦法應無效，因此提起行政訴訟，向東華大學追討800元。

東華大學則強調，陳男主動申請停車證且依規定繳費，顯然知道要繳每年400元仍願意申請，便與校方達成合意。至於相關收費辦法，國立大學享有大學自治權利，制定辦法於法有據。

一審花蓮地方法院判決陳男敗訴，理由是確實是否收費，為大學自治範圍內，且校園清潔確實需要經費維護，東華大學自籌收入並無不當。陳男不服，提起上訴。

台北高等行政法院認為，東華大學為校園管理，發行種類不同識別證管制車輛進出，並依識別證不同給予不同收費標準，是落實使用者付費。

而收費辦法中，給予教師、學生車輛優先進入校園的權利，費用也有優惠，符合成本考量，具合理性，相關辦法也送行政會議通過，公告上網，又該項費用屬利用校園設施之規費，與一般停車場業者營利不同，因此判決陳男敗訴確定。
